MS sued over use of Vista capable logoA class-action lawsuit alleging that Microsoft deceived consumers has been given the green light by a federal court. The suit, fi led in Seattle, WA, alleges that Microsoft’s “Vista Capable” logo program—used on machines prior to the release of the OS—was intentionally misleading.

Many of the PCs that sported the badge used Intel’s anemic 915 integrated graphics chipset, which was incapable of running Vista’s 3D Aero interface. Federal judge Marsha Pechman allowed the case to proceed based on a “price inflation” theory that consumers were tricked into paying more for machines with the “Vista Capable” badge. How bad were the Vista Capable machines? One email from a Microsoft employee said “even a piece of junk will qualify.”

Microsoft Corp Chief Executive Steve Ballmer pledged that the company would gain share against Google Inc in online advertising and Web searching, even if it’s his “last breath” at the company.

“So it may be my last breath at Microsoft, but we’re going to be there, working away, building share,” said Ballmer during a bantering question-and-answer session with Guy Kawasaki, a venture capitalist and one of the first employees at Apple Inc.”In online, yeah, it’s Google, Google, Google, and we’re in the game. We’re just the little engine that could,” joked Ballmer, whose company is the world’s largest software maker.

In the wide-ranging chat with Kawasaki, Ballmer addressed criticism about Windows Vista, launched a few subtle jabs at Apple, and even re-enacted an infamous dance that earned him Web video fame and earned him the unflattering nickname of “Monkey Boy” in some Internet circles.

“We’ve made an offer, and it’s out there, baby,” said Ballmer. The deal was originally worth $44.6 billion, but Microsoft’s stock slide has pushed down its value. The Microsoft CEO said if a deal should go through, the two companies will look to reduce overlapping areas.”We shouldn’t have two of everything. It won’t make sense to have two search services, two advertising services, two mail services, and we will have to sort some of that through,” said Ballmer.

Kawasaki did not hesitate to bring up past embarrassing moments for Ballmer, including references in an lawsuit that claimed Ballmer threw a chair at a former employee who said he was leaving Microsoft for Google. “Don’t pick up a chair and throw it at me,” Kawasaki said with a laugh. “Don’t go monkey on me either.”

Microsoft StartKey - Windows on a USB

Microsoft has been working on a new product known as “StartKey” — that will allow users to carry their Windows and Windows settings with them. StartKey isn’t just for USB sticks; it also will work on other flash-storage devices, like SD memory cards.

StartKey has its roots in an agreement Microsoft made with SanDisk in May 2007. Microsoft announced it would be providing software to replace the U3 Smart Technology that was included on SanDisk flash devices.

Microsoft acknowledges the truth about Vista

Microsoft finally publicly acknowledged what most of us have known all along. It blinks and reduced the price of Vista, while acknowledging the fact that Vista sales is poor in retail segment.

The main segment of Microsoft’s revenue with Vista has been in selling OEM versions, which is shipped with a new PC/Laptop. However it is only a matter of time before computer vendors realize that they can provide alternative operating systems like Linux distros like Fedora or Ubuntu for free.

‘Yahoo or not, the Web is hot’ says Gates

SEATTLE: Microsoft Corporation plans to invest heavily in Web search to compete against Google Inc, even if it fails to acquire Yahoo Inc, the company’s chairman Bill Gates said.

“We can afford to make big investments in the engineering and marketing that needs to get done. We will do that with or without Yahoo,” said Gates in an interview with Reuters.

The two companies are at a stand-off in Microsoft’s $41.7 billion unsolicited bid to acquire Yahoo. Microsoft has offered to buy Yahoo for $31 a share in cash and stock, a bid which Yahoo’s board rejected, saying it undervalued the company.Microsoft countered by saying its offer was “full and fair,” but did not say what it planned to do next. Analysts expect Microsoft to sweeten its bid, possibly to $35 a share, to clinch a deal.

Microsoft Corp.’s online advertising researchers will spend this year teaching computers to be smart about sticking ads into video clips, and to be even smarter about targeting ads to specific Web surfers.
